Assistant Professor Dr. Abdullah Abdul Amir Taha, Professor of Civil Law at our college, participated in the membership of the committee to discuss a doctoral thesis on the role of legislative policy in reducing the dissolution of the marital bond – a comparative study, submitted by the student Hussein Kanaan Falih.
The study aimed to clarify the role of legislative policy in reducing the dissolution of the marital bond, as successful legislative policy depends on the rule that prevention is better than cure, and that the Islamic society is a role model for all nations and must be a role model and an example to be emulated with regard to the family and marriage, and what may arise after that in terms of divorce and separation.
The study concluded that the main problem that the family suffers from and may lead to the dissolution of the marriage contract is due to the ignorance of individuals of the duties of married life, in addition to the fact that the dissolution of the marriage contract is a license and an exception to the rule, and therefore comparative legislations indicated in most cases of terminating the marriage contract, the reasons that lead to the lapse of the use of this license, and this matter was not addressed by the Iraqi legislator in the Personal Status Law.
